Terms of Service

1. Acceptance of these Terms

These Terms of Service (the “Terms”) govern access to and use of The Peterson Index and any related website, search interface, software, content, features, and services (collectively, the “Service”). The Service is operated by [LEGAL ENTITY NAME] (“we,” “us,” or “our”).

3. No accuracy or completeness guarantee

We do not warrant or represent that the Service, its search index, transcripts, captions, timestamps, links, excerpts, metadata, summaries, classifications, or search results are accurate, complete, current, reliable, suitable, available, or error-free.

Search results are generated from available source material and technical processes. They may omit relevant material, return irrelevant material, contain transcription or timing errors, fail to reflect the speaker’s complete context, or become unavailable without notice. Search results are not authoritative statements by the speaker, the rights holder, The Peterson Index, or the Jordan Peterson Foundation.

You should consult the original recording and other reliable sources whenever accuracy matters.

4. Source material and third-party services

The Service may index, quote, display, link to, or embed material obtained from publicly accessible services and sources, including YouTube and other third-party platforms. Except for technical formatting, indexing, excerpt selection, metadata organization, and presentation, we do not intentionally edit the underlying source material.

“Publicly accessible” does not necessarily mean “public domain,” “licensed for every use,” or “free of copyright, privacy, publicity, trademark, or other restrictions.” We do not claim ownership of third-party material merely because it appears in, is linked from, or is indexed by the Service.

Third-party services are independent from us. We do not control their availability, content, policies, algorithms, advertising, privacy practices, or terms. Your use of a third-party service is governed by that service’s own terms and policies, including YouTube’s Terms of Service and Privacy Policy. We are not responsible for third-party services or anything that occurs after you follow a third-party link or open an embedded player.

The Peterson Index is an independent project. Unless expressly stated otherwise, it is not affiliated with, endorsed by, sponsored by, or operated on behalf of Jordan Peterson, the Jordan Peterson Foundation, YouTube, Google, or any source, speaker, publisher, platform, or rights holder.

5. Permitted use

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable permission to access and use the Service for your personal, non-commercial, lawful educational and entertainment purposes.

You must use the Service in good faith and comply with all applicable laws, regulations, third-party rights, and platform terms.

6. Fair use and prohibited conduct

You must not, and must not assist or encourage another person to:

• use the Service for unlawful, fraudulent, abusive, harassing, threatening, defamatory, hateful, discriminatory, deceptive, or harmful purposes;
• use automated systems, bots, crawlers, scrapers, scripts, data-mining tools, headless browsers, or similar methods to access, query, copy, monitor, or extract the Service or its results, except for ordinary search-engine indexing that respects our published instructions;
• send excessive, repetitive, or deliberately expensive requests, bypass rate limits, defeat human-verification controls, rotate identities to evade restrictions, or otherwise interfere with the Service;
• overload, probe, scan, attack, reverse engineer, decompile, disassemble, bypass, disable, or circumvent any security or access-control measure;
• copy, reproduce, republish, frame, mirror, sell, license, distribute, or commercially exploit the Service or third-party material except as expressly permitted by law, the relevant rights holder, or the applicable third-party platform;
• use the Service to identify, profile, stalk, target, discriminate against, or infer sensitive information about another person;
• submit personal, confidential, proprietary, health, financial, authentication, or other sensitive information into a search field or support channel unless it is necessary and lawful to do so;
• impersonate another person or organization, falsely suggest an affiliation, or misrepresent the source or status of any material; or
• use the Service in a way that could expose us, our providers, other users, rights holders, or third parties to liability or harm.

We may investigate suspected misuse and may cooperate with lawful requests from authorities, platforms, rights holders, or service providers.

7. Fair usage policy and human verification

The Service is shared infrastructure. We may impose or change reasonable limits on request frequency, daily usage, concurrency, search complexity, storage, bandwidth, or other resource consumption. Limits may be applied by IP address, network, session, account, device, request characteristics, or other signals.

We may require a CAPTCHA-like human-verification step, including Cloudflare Turnstile or another provider, before or during use of the Service. Human verification is not a guarantee that a person is trustworthy or that automated activity cannot occur.

Attempts to bypass fair-use limits, rate limits, or verification controls are prohibited. We may reject, delay, throttle, suspend, or block requests that appear automated, abusive, excessive, risky, or inconsistent with these Terms.

8. Refusal, suspension, and termination

To the maximum extent permitted by applicable law, we reserve the right to refuse, restrict, suspend, or terminate access to all or any part of the Service, at any time, with or without notice, and with or without stating a reason. This may include action for suspected misuse, security concerns, legal or regulatory reasons, third-party requests, operational reasons, or any other reason we consider appropriate.

This discretion does not authorize unlawful discrimination or removal of rights that cannot legally be removed. Where applicable law requires notice, an explanation, an appeal process, or continued access to certain information, we will comply with that law.

Upon termination, your permission to use the Service ends immediately. Provisions that by their nature should survive termination—including disclaimers, limitations of liability, indemnity, intellectual-property provisions, dispute provisions, and miscellaneous provisions—survive.

9. Changes and availability

We may add, remove, modify, suspend, or discontinue the Service or any feature, source, index, result, link, or content at any time. We do not promise advance notice, uninterrupted access, preservation of any material, or continued availability of any particular feature, except where notice is required by law.

We may update these Terms from time to time. The updated version will be posted with a new “Last updated” date. Your continued use after the effective date of an update constitutes acceptance to the extent permitted by law. If a change materially affects your legal rights and applicable law requires a different form of notice or consent, we will provide it.

10. Intellectual property

The Service’s software, design, compilation, selection, organization, branding, and original interface elements are owned by or licensed to us and are protected by applicable law. No rights are granted except those expressly stated in these Terms.

Third-party names, marks, recordings, transcripts, captions, images, logos, and other material remain the property of their respective owners. Nothing in the Service grants you a license to use any third-party rights.

You must not remove, obscure, or alter copyright, trademark, attribution, or other proprietary notices.

11. Copyright and rights-holder notices

If you believe material made available through the Service infringes your copyright, privacy, publicity, trademark, or other rights, contact us through the support address above with:

• your name and contact information;
• identification of the material or right allegedly affected;
• the specific URL or other location of the material;
• an explanation of the concern and your interest in the right; and
• any information reasonably necessary for us to evaluate the request.

We may remove, restrict, correct, or disable access to material or links at our discretion and without admitting liability. We may request additional information, forward a notice to an affected party where legally appropriate, or direct a copyright complaint to the relevant platform or rights holder.

12. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL MATERIAL, RESULTS, LINKS, TRANSCRIPTS, CAPTIONS, INDEXES, SOFTWARE, AND FEATURES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND.

WE DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES AND CONDITIONS, INCLUDING WARRANTIES OR CONDITIONS OF ACCURACY, COMPLETENESS, MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, SECURITY, AVAILABILITY, RELIABILITY, COMPATIBILITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, PRODUCE ANY PARTICULAR RESULT, PRESERVE ANY DATA, BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OR BE FREE OF VIRUSES, VULNERABILITIES, OR OTHER HARMFUL COMPONENTS.

Nothing in these Terms excludes a warranty, condition, representation, or right that applicable law does not permit us to exclude.

13. Limitation of liability

This exclusion includes, without limitation, direct, indirect, incidental, special, consequential, exemplary, punitive, reliance, or cover damages; loss of profits, revenue, business, goodwill, opportunity, anticipated savings, reputation, use, or data; business interruption; procurement of substitute services; personal or professional decisions; reliance on inaccurate or incomplete material; third-party content or services; security incidents; malware; unauthorized access; delays; outages; suspension or termination; and loss, corruption, removal, or unavailability of any content or data, even if we were advised that such damage was possible.

If any liability cannot legally be excluded, then, to the maximum extent permitted, the Released Parties’ total aggregate liability for all claims arising out of or relating to the Service or these Terms will be limited to the greater of EUR 0 and the amount you paid directly to us for the Service during the twelve months before the event giving rise to the claim. If applicable law does not permit a zero cap, the liability cap will instead be the minimum amount required by that law or EUR 100, whichever is lower to the extent legally permitted.

Nothing in this section limits liability or rights that cannot legally be limited, including liability for fraud or fraudulent misrepresentation, intentional misconduct, death or personal injury caused by negligence where non-waivable, or mandatory consumer, privacy, data-protection, or other statutory rights.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Released Parties from claims, demands, proceedings, damages, liabilities, losses, penalties, costs, and expenses—including reasonable legal fees—arising out of or relating to:

1. your access to or use of the Service;
2. your breach of these Terms or applicable law;
3. your misuse of the Service or attempt to bypass controls;
4. your violation of another person’s or entity’s rights; or
5. any material, data, or communication you submit or transmit to us.

We may assume exclusive control of the defense of any matter subject to indemnification. You will reasonably cooperate. You may not settle a claim in a way that admits fault by or imposes obligations on us without our prior written consent.

15. Third-party beneficiaries and providers

Our service providers, licensors, content providers, and the other Released Parties are intended third-party beneficiaries of the disclaimers, limitations, indemnity, and protections in these Terms to the extent permitted by law. Third-party beneficiaries may enforce those protections where legally permitted.

16. Governing law and disputes

These Terms are governed by the laws of The Netherlands, excluding its conflict-of-law rules, except to the extent mandatory law in your place of residence applies.

Subject to mandatory consumer rights, claims may be brought in the courts of The Netherlands. Nothing here prevents a consumer from bringing a claim in a forum or under a law that cannot legally be excluded.

17. General provisions

These Terms and the Privacy Policy are the entire agreement concerning the Service and replace prior agreements on the same subject. If a provision is held invalid or unenforceable, it will be limited or replaced to the minimum extent necessary, and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. We may assign these Terms; you may not assign them without our written consent.

We are not responsible for delay or failure caused by events beyond our reasonable control, including outages, infrastructure failure, cyberattacks, labor disputes, natural disasters, government action, war, epidemic, or failures of third-party platforms and providers.

Privacy Policy

1. Scope and controller

This Privacy Policy explains how [LEGAL ENTITY NAME] (“we,” “us,” or “our”) processes information in connection with The Peterson Index and the Service.

For users in the European Economic Area, the United Kingdom, and Switzerland, [LEGAL ENTITY NAME] is the controller of personal data processed for the Service, unless a specific notice states otherwise.

2. Our privacy approach

We do not intentionally ask ordinary visitors for their name, email address, telephone number, account credentials, precise location, or other identifying information. We do not sell personal information, use it for targeted advertising, or build cross-site advertising profiles.

We aim to operate the Service with data minimization. In particular, our product analytics are designed not to use cookies, local storage, persistent visitor identifiers, or device fingerprinting. We do not intentionally retain raw search queries as analytics records.

However, “no personally identifiable information is kept” does not mean that no technical information is ever processed. Hosting providers, security systems, human-verification providers, embedded third-party services, and ordinary internet infrastructure may temporarily process technical information such as IP address, browser data, request time, or security signals. We describe the main categories below.

3. Information we may process

A. Search and interaction information

When you use the Service, we may temporarily process the search words, selected filters, requested page, result identifiers, and interaction needed to return the requested result.

We do not intentionally store raw search queries in the product-analytics database. Search queries may nevertheless appear temporarily in application memory, browser history, network infrastructure, error diagnostics, backups, or a third-party service used to provide search. Do not submit personal, confidential, medical, financial, authentication, or other sensitive information.

We may retain controlled aggregate information such as:

• that a search was submitted or completed;
• whether it returned results, no results, or an error;
• a broad, non-personal topic classification, where available;
• which controlled video or content identifier was opened or clicked; and
• broad result-position or feature-use categories.

B. Technical and security information

For security, reliability, rate limiting, abuse prevention, troubleshooting, and legal compliance, our infrastructure or providers may process:

• IP address or network information;
• request date and time;
• browser family, operating-system family, and device class;
• referrer and requested path;
• response status, latency, error, and diagnostic information;
• rate-limit and human-verification outcome; and
• information reasonably necessary to detect malicious or automated activity.

We do not use this information to create a persistent cross-site fingerprint or advertising profile. Security records may be retained for a limited period and may be preserved longer where reasonably necessary to investigate an incident, comply with law, establish or defend legal claims, or protect the Service.

C. Privacy-preserving product analytics

If product analytics are enabled, we may collect fixed, coarse event data such as:

• event type, for example search, result display, result click, video open, play attempt, or error;
• controlled content or video identifier;
• broad device class and browser family;
• primary browser language;
• approximate country or region, if enabled;
• broad time bucket; and
• broad outcome or result-position bucket.

We do not intentionally collect for product analytics:

• raw search queries;
• full IP addresses;
• full user-agent strings;
• device or browser fingerprints;
• persistent visitor or session identifiers;
• cookies or local storage used to track visitors;
• unrestricted URLs, referrers, or query parameters;
• names, email addresses, account IDs, or contact lists; or
• free-text analytics payloads.

Aggregated statistics may be retained longer than event-level records. Small or rare groups may be generalized or suppressed to reduce re-identification risk.

D. Information you send to us

If you contact us, we may receive your email address, name, message, attachments, and any other information you choose to provide. We use it to respond, investigate, administer the Service, comply with law, and protect our rights. Do not include unnecessary personal or sensitive information in a message.

E. Cookies and similar technologies

We may use strictly necessary cookies or equivalent technical storage for security, human verification, load balancing, session integrity, or other essential functions. We do not use analytics cookies for cross-site tracking or advertising profiles.

For search verification, we use a host-only browser-session cookie named `__Host-pi_verify` in production. It contains a random identifier, not a search query. The server keeps a short-lived counter so a completed human check covers up to three searches. The cookie ends with the browser session, and the server record expires after 12 hours or when the application restarts.

If we introduce any non-essential cookie, local-storage item, advertising technology, persistent identifier, or similar tracker, we will update this Policy and obtain consent where required by applicable law.

Browser settings, content blockers, and third-party opt-out mechanisms may affect how the Service works.

F. Human-verification providers

We may use Cloudflare Turnstile or another human-verification provider to protect the Service. The provider may process information about your browser, device, network, and interaction to assess whether a request is automated. We send the minimum information necessary for verification and do not intentionally send your search query as part of the challenge.

Cloudflare’s own privacy notice, terms, subprocessors, retention, and international-transfer practices apply to its processing.

G. Search, hosting, and infrastructure providers

The Service uses OpenAI for LLM-assisted search processing. Search queries and limited transcript context are sent to OpenAI to provide the requested search result.

The principal third-party providers currently involved are listed below:

We process information for the following purposes:

1. provide, maintain, and secure the Service;
2. receive and answer searches;
3. prevent abuse, scraping, fraud, attacks, and excessive use;
4. measure aggregate usage and improve search quality, reliability, accessibility, and content organization;
5. communicate with people who contact us;
6. comply with legal obligations and respond to lawful requests; and
7. establish, exercise, or defend legal claims.

Depending on the data and applicable law, our legal bases may include performance of a requested service, legitimate interests in operating and securing the Service, compliance with legal obligations, and consent where required. We will not rely on legitimate interests as a blanket permission for fingerprinting, targeted advertising, cross-site tracking, or processing sensitive query profiles.

Where processing is based on consent, you may withdraw consent at any time. Withdrawal does not affect processing that occurred before withdrawal.

5. Sensitive information

Search terms and support messages can sometimes reveal health information, religious or philosophical beliefs, political opinions, sexuality, or other sensitive information. We do not need this information to provide ordinary use of the Service and ask you not to submit it.

We do not intentionally create individual profiles or infer sensitive characteristics from searches. Aggregate topic statistics are designed to describe general use of the Service and not to evaluate, identify, target, or make decisions about individual people.

6. Sharing and disclosure

We may disclose information only as reasonably necessary for the purposes described in this Policy, including to:

• service providers acting on our instructions;
• security, hosting, support, search, analytics, or infrastructure providers;
• professional advisers, insurers, auditors, or prospective transaction parties subject to appropriate confidentiality;
• authorities, courts, rights holders, or other parties where required or permitted by law; and
• another party when you direct us to do so or clearly use an independent third-party service.

We do not sell personal information or share it for cross-site targeted advertising.

7. International transfers

Some providers may process information outside the country where you live or outside the European Economic Area. Where applicable, we will use a legally recognized transfer mechanism and appropriate safeguards, such as an adequacy decision, standard contractual clauses, or another lawful mechanism.

8. Security

We use reasonable technical and organizational safeguards appropriate to the nature and risks of the information, including access control, minimization, separation of operational and analytics data, secure transport, backups, and monitoring.

No method of storage or transmission is completely secure. We cannot guarantee that the Service or any provider will never be compromised, interrupted, lost, altered, or accessed without authorization.

9. Your privacy rights

Subject to applicable law and permitted exceptions, you may have the right to:

• obtain information about our processing;
• access personal data we hold about you;
• request correction or deletion;
• request restriction of processing;
• object to processing based on legitimate interests;
• withdraw consent;
• receive portable data where applicable; and
• lodge a complaint with a competent data-protection authority.

To exercise a right, contact [email protected]. We may need reasonable information to verify the request and protect against unauthorized disclosure. If we cannot locate personal data because our design does not retain an identifying record, we will explain that limitation. We will not discriminate against you for exercising a legally protected right.

10. Children

The Service is intended for a general audience and is not directed to children under 16. We do not knowingly request or intentionally retain personal information from children for advertising or profiling. If a parent or guardian believes a child has provided personal information, contact [email protected] so we can assess and delete it where required.

11. Third-party websites and embedded content

The Service may link to or embed YouTube and other third-party content. When you open or interact with that content, the third party may receive technical information and may place or access technologies according to its own policies. This Privacy Policy does not govern third-party processing.

Review the third party’s privacy policy before using its service. We are not responsible for a third party’s collection, use, retention, security, or disclosure of information.

We may update this Privacy Policy to reflect changes in the Service, providers, law, or our processing practices. We will post the updated version with a new “Last updated” date. Where required by law, we will provide additional notice or obtain consent.
